Man who co-discovered HIV accused of stealing rights to Aids cure

A Nobel prize-winning French researcher who co-discovered the virus that leads to Aids but sparked controversy after his colleague said he had claimed all the glory, has now been accused of stealing the rights to a revolutionary invention that may provide a cure to the disease, it emerged yesterday.

By Henry Samuel in Paris

Last Updated: 3:58PM GMT 09 Mar 2009

Prof Luc Montagnier is locked in a legal battle with inventor Bruno Robert over the intellectual property rights to a technique whereby the Aids virus and other serious ailments, including Parkinson's and Alzheimer's disease, can be pinpointed by their electromagnetic "signatures".

The hope is that once identified, the diseases can be blocked or neutralised with an opposite electromagnetic signal.

Mr Robert, 47, approached Mr Montagnier in May 2005 with his work on electromagnetic waves. In November of that year, Mr Bruno registered a patent for the process of homing in on a "biochemical element presenting a biological activity through the analysis of low-frequency electromagnetic signals." A month later, France's patents body, Inpi, was surprised to a request for the very same patent from Prof Montagnier.

Last Tuesday, Prof Montaignier took Mr Bruno to court, claiming the intellectual property rights over the discovery. The verdict is due on 20 May.

Mr Bruno's lawyer alleged in Le Journal du Dimanche that Prof Montagnier had already admitted that he had not come up with the discovery, as he had signed a contract to use Mr Bruno's technique in 2005 in exchange for 100,000 euros per year over a five-year period. Mr Bruno never received any payment. Prof Montagnier's lawyer said the pair had only signed a "protocol agreement" which was not legally binding.

Prof Montagnier was awarded a Nobel prize last year for discovering the virus that leads to Aids along with Françoise Barré-Sinoussi. A third researcher, Jean-Claude Chermann received no award despite being hailed by peers as a key driving force in the lab.

Prof Chermann accused his former colleague of squeezing him out by intense lobbying. "Frankly, Montagnier, everyone laughs about him," he told Le Monde. "He followed communication lessons, cut his moustache, put on a little waistcoat...He played the mandarin like hell. I, for one am not a (re)searcher, I'm a finder," he said.

NexBio

NexBio - another possible company cohort for NanoViricides:

Fludase® (DAS181) is a broad-spectrum drug candidate for the prophylaxis and treatment of respiratory infections by all types of influenza virus, including the types of virus that may cause a potential influenza pandemic, as well as all types of parainfluenza virus. Fludase® is currently in phase I clinical development, and has successfully completed its First-In-Man trial.

MECHANISM OF ACTION: FLUDASE® BLOCKS IFV ENTRY INTO CELLS

Fludase® is a recombinant fusion protein (see figure 1) that inactivates viral receptors on the cells of the human respiratory tract, thereby preventing influenza and other viruses such as parainfluenza from both infecting the human body and amplifying in already-infected individuals.

In the human respiratory tract, cell-surface sialic acids act are the host cell receptors for all influenza A and B and parainfluenza viruses. Fludase® works by inactivating these sialic receptors in the airway epithelium, therefore preventing viral entry into cells.

Finally, I would like to express my gratitude for the support of the National Institutes of Health and the National Institute of Allergy and Infectious Disease, without which our critical research would not be possible.

NexBio is a five-year-old biotechnology company located in San Diego, California, founded to create and commercialize novel, broad-spectrum biopharmaceuticals to prevent and treat current and emerging life-threatening human disease. All funding to date has been from the National Institutes of Health in the form of grants and contracts, totaling ~$63 million.
Source

  • NexBio lives off grants, year after year, $63 Million in 5 years, so far.
  • I note that NexBio uses the sialic acid stuff in their virus fighting efforts. They block the virus from attaching to the cell it is targeting by interfering with the sialic acid attachment points on cells. They block those attachment points with a covering chemical so the virus has no way to attach to the cell it seeks. I think they do their thing on the cells themselves and do not do anything to the virus directly. NNVC does attack the virus directly and immobilizes it by making the cide look to the virus like a cell with the same sialic acid attachment points that the virus attaches to and becomes trapped unable to infect any cells themselves.

  • I found this:
Hemagglutinin, displayed at left, is one of two virally-coded integral envelope proteins of the influenza virus. Hemagglutinin is responsible for host cell binding and subsequent fusion of viral and host membranes in the endosome after the virus has been taken up by endocytosis. In the first step of infection it binds to sialic acid residues of glycosylated receptor proteins on target cell surfaces.
Source

  • So...I guess NNVC targets the sialic acid binding bits on the virus (making the virus think the cide particles are the host cells by presenting sialic acid binding sites for the virus to attach to), whereas NexBio tagets the sialic acid itself on the cell that the virus is looking to bind to and covers it so the virus can't find it. Two sides of the same coin perhaps?
  • Re the government giving grants:
  • Wouldn't it make sense to combine the likes of NNVC and NexBio into one grant? More bang for the buck? They certainly are similar!
  • Re NexBio funding:
Corporate funding to date has been entirely non-dilutive, consisting of five grants totaling $13M, together with a BAA
Contract for $49.8M to support Fludase(R) development, all from the National Institute of Allergy and Infectious Diseases, part of the National Institutes of Health.

INNOVALL - Patent Search Engine

A patent success

January 16th, 2009 in Technology / Computer Sciences

(PhysOrg.com) -- A European project has created a powerful patent search service for SMEs. It is a major step forward as patents and patent information are extremely valuable.

We live in a knowledge economy, and patents are the legal tender. They define a company’s or individual’s stake and they are the mechanism by which ideas can be both exchanged and, at the same time, protected.

But getting patent information can be difficult. There are many databases scattered across Europe and the rest of the world, and the search options are limited: they are either cheap but restricted, or effective but very expensive. You must either go through each source for information, or pay hefty fees to a specialist who does it for you.

That leaves SMEs, the majority of Europe’s enterprises, in a bind: either they struggle with the awkward, difficult and time-consuming cheaper search (which ends up costing money in any case because of the time personnel must devote to the work), or they incur serious costs using professionals.

Unsuspected value

The final option is to ignore patents altogether, but this is a costly option, too. Costly in terms of the lost opportunities, as most SMEs don’t even begin to suspect the value of the information discovered through patent searches.

Innovall, an eTEN-funded project, is keen to see SMEs not miss out on the value of patenting and patent knowledge.

For example, one company that participated in the Innovall project, a tyre manufacturer, sought a solution to a problem it was having with waste rubber extruded through the mould during the manufacturing process. By using Innovall’s search service the tyre company discovered a useful patent in the baking industry of all things.

“It shows how useful and valuable information can be discovered, even if it relates to a completely different industry,” explains Alfredo Silva, coordinator of the Innovall project.

Google for patents

Innovall was set up to explore the best way to make patent search simple. The solution was to create a web portal that essentially acts as the Google for patents. The search engine connects with eight large databases, with hundreds of thousands of patent records.

There are three layers of search that companies can choose from. The most basic level is the ‘function’ search, which looks for patents in terms of what they do. This may be basic, but it is also very powerful, as the example of the tyre company shows.

Even better, Innovall has used ontologies, which are dictionaries that translate different terms to help define a search. “For example, you might be looking for a friction device, but the system will also search for words like drag, brake, decelerate and so on,” explains Silva.

That’s just the beginning. A ‘company’ search will look up all the patents registered by one company, a competitor perhaps, and it will list information such as what country, branch or even department submitted the patent. Finally, Innovall can search by ‘product name’, completing the range of services.

The results take a bit longer than a standard Google search, but given the nature of the search, this is to be expected.

Keen hunters

The 60 organisations - and hundreds of individuals within them - who are currently actively testing the system are very enthusiastic about the results and the information that Innovall retrieves.

These ‘testers’ will be a key part of the next step. Innovall hopes to convert them to a core group of users of the service when it goes live in earnest. This will boost efforts to commercialise the service, because it must become sustainable if it is going to survive.

Right now, Innovall is considering a variety of business models. One plan is to leave the ‘function’ service free, and then charge tiered subscriptions for more detailed or specific searches.

For now, the project will continue to perfect the technology until March 2009, when they hope to have their business plans finalised and ready for prime time.

“This is a very important service,” says Silva. “It fills a glaring gap in current offerings, it empowers SMEs to get to grips with patents, and it offers the potential to boost European competitiveness.”

The Innovall Market Validation project received funding from the eTEN programme.

Quantum Solar Power Corp., Inc.

I am talking my head off here and elsewhere trying to get NNPP or anybody else to get interested in this rectenna development by NNPP's grandpa, a guy named Howard K. Schmidt.

Look here for the rectenna stuff so far:
http://donpatent.blogspot.com/2008/05/inventor-schmidt-howard-k.html

I think rectenna empowered solar could bury oil but what company will develop it is unknown - that's why I would like to see NNPP participate and use either Ren (Boston College) or Schmidt's developments or both to cover all the bases.

Re QVQV:

QV, Quantum Ventures Enters into Agreement with Canadian Integrated Optics International to Manufacture & Market CIOI's Patent Pending Solar Technology
04/16/2008

QV Quantum Ventures Inc. announced that the company has entered into a License agreement with Canadian Integrated Optics International Ltd. of Douglas, Isle of Man (CIOI), to manufacture and market CIOI's patent pending solar technology based on an optical rectenna. Closing of this agreement will occur on or about May 16, 2008 and is subject to certain terms and conditions. The Purchase Price for the license shall be paid in shares of the Company's common stock and a royalty.

I got this out of the 8K: http://sec.edgar-online.com/2008/04/16/0001096350-08-000061/Section6.asp

"Patent Rights" means issued patents and pending patent applications in any country in respect of an invention owned by the Licensor relating to the Technology, including provisionals, continuations-in-part, continuations, divisionals, re-issues and extensions of those issued patents and pending patent applications, including inventions described in the specifications of United States Patent Application Numbers 60/911,847, 60/911,815, 60/911,823 and 60/911,837 filed on April 13, 2007.

I searched and found nothing - they are not yet published. '60' signifies an early incomplete informal filing to get an early filing date - they have a year to get a proper application filed and to maintain that early filing date.

Rectenna. Remember it - it will change the world.

Goodbye oil and coal, hello rectenna solar.

What is a rectenna? It is an antenna which receives electromagnetic waves from the sun, for example, and converts them into rectified direct electric current.
